BRILA MODA Privacy Notice

In compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties ("the Law")—specifically Articles 15, 16, 17 (Section II), 36, and other applicable sections—BRILA MODA (hereinafter the "Data Controller") hereby informs you of the processing to which your personal data ("Personal Data") will be subjected. Such data will at all times be collected, used, stored, and/or distributed in accordance with the Law and the terms set forth in this Privacy Notice.
Protecting users' personal data is of vital importance to the Data Controller. Therefore, this notice aims to inform you about the processing and handling of the information provided—in compliance with applicable legislation—since using the Data Controller's services involves providing personal data for subsequent use, and also outlines the rights that users may exercise.
By accepting the privacy policy, the user authorizes BRILA MODA and its affiliated brands—including, but not limited to: Fashion Digital Talks, Fashion Startup, and Laura Erre (hereinafter "the Brands")—to process their personal data for all or some of the purposes set forth herein. BRILA MODA may modify this Privacy Notice at any time; the user will be notified of any substantial changes to ensure they are not adversely affected.

Identity and address of the data controller

Pursuant to Article 16, Section I of the Law, you are hereby informed that:
BRILA MODA (the “Data Controller”) is a business entity duly incorporated under the laws of the United Mexican States, with its principal place of business at Conchitas 3009, Col. Loma Bonita, Postal Code 45086, Zapopan, Jalisco, Mexico, and shall be responsible for the handling and processing of your Personal Data.

Personal Data

The Data Controller may collect and, where applicable, process the following Personal Data, depending on the information requested regarding our services and/or the contracted service, as well as factors such as nationality, occupation, age, and/or country of tax residence:

Identification data: Full name, nationality, handwritten signature, RFC (Tax ID), CURP (Population Registry Code), photograph, national personal identity card number.
Images: Photographs, videos, posters, or any element containing the user's personal image.
Identification documents: Passport, National Institute for Older Adults (INAPAM) ID card, voting ID card, personal identity card issued by the National Population Registry (RENAPO) of the Ministry of the Interior (SEGOB).
Contact data: Full address, email address, telephone number.
Billing data: Tax address, Tax Identification Certificate (Cédula de Identificación Fiscal) or Tax ID number (NIF/CIF), and tax compliance status report issued by the Tax Administration Service (SAT).
Financial data: Banking details, credit or debit card number.
Academic data: Professional license, ID card issued by public or private educational institutions with official recognition (including photograph and signature, for minors).
Size data: T-shirt or shirt size, trouser size, shoe size, sweatshirt size, or size for any other garment.

It is important to clarify that not all the aforementioned data will be requested; the specific data required depends on the individual and the service requested. Furthermore, the data provided is used to finalize the agreed-upon service. The user may refuse to provide certain data; however, failure to provide such data may result in the inability to deliver the requested service.

The Data Controller may retain the information in its database for as long as permitted by law in order to streamline the future provision or offering of the service in question, as well as for the duration necessary to fulfill the purposes that justified the processing of your Personal Data (by virtue of the legal relationship with us). Once this is concluded, your Personal Data will be blocked (for the period permitted by applicable laws) and subsequently deleted.

BRILA MODA DOES NOT COLLECT SENSITIVE DATA FROM USERS.

The purposes for which we collect your Personal Data are as follows:

Primary Purposes:
To provide you with information regarding the service that interests you;
To provide the service you request or require;
To communicate with you in order to attend to and follow up on the services requested, contracted, and provided by the Data Controller;
To address any complaints or comments regarding the services contracted or requested;
To prepare the corresponding invoices for services and/or products requested from or contracted with the “Data Controller” and “the brands”;
To communicate with you to manage and collect outstanding balances;
To create a record containing your name, telephone number, email address, and, if necessary, banking details;
To create videos, signs, or various physical and digital materials for use in advertising and event promotion;
To create promotional merchandise, such as t-shirts or sweatshirts, which may be given to the user depending on the specific case;
If you formally accept the services or products offered by the Data Controller, your Personal Data will be used to fulfill the obligations arising from our legal relationship.

Secondary Purposes:
To inform you about new services or products;
To inform you about promotions;
To evaluate the quality of the service you contracted.

These secondary purposes are not necessary to provide the requested service; however, they are tools that allow us to provide you with better care and service, as well as to improve our website.

If you do not wish for your Personal Data to be used for the aforementioned secondary purposes, please indicate this by marking an "X" in the corresponding box in the paragraph below <> and sending this document to the email address brilamoda@gmail.com.

Rights of Data Subjects Regarding Personal Data

The Federal Law on the Protection of Personal Data Held by Private Parties grants data subjects the following rights:

  1. To be informed of the privacy notice

  2. To access personal data held by the data controller

  3. To rectify information that is inaccurate or incomplete

  4. To have their personal data cancelled (deleted)

  5. To object to the processing of their data

  6. To request that the data controller grant access to, rectify, cancel, or allow objection regarding their personal data

How are the data processed and protected?

 

Personal Data will be processed in accordance with the Law and its Regulations. The confidentiality of such data is guaranteed, and the data are protected by administrative, technical, and physical security measures to prevent damage, loss, alteration, destruction, misuse, or unauthorized access and disclosure; it is understood that only authorized personnel of the Data Controller will have access to your Personal Data for the purposes stated in this Privacy Notice.

 

The Personal Data collected by the Data Controller will be processed in compliance with the guiding principles for Personal Data protection set forth in Article 9 of the Regulations to the Law, namely: lawfulness, consent, information, quality, purpose, loyalty, proportionality, and accountability. Furthermore, the Data Controller will observe the security and confidentiality obligations referred to in Articles 19 and 21 of the Law.

How can you exercise your rights?

You have the right at any time to access your Personal Data and rectify it if it is inaccurate; likewise, you may cancel or object to the processing of such data if you consider its use excessive or unnecessary for the purposes that justified its collection.

Please include a written statement containing the following information:

The name of the data subject, address, and email address for communicating the response to your request, with the understanding that the response(s) to your request(s) will be sent to the email address you provide;

Documents proving your identity (a scan or simple copy—in printed or electronic format—of your voter ID card, passport, professional license, or FM-3 document), personal identity card, or, where applicable, proof of legal representation for the Personal Data subject (a scan or simple copy) consisting of either (i) a simple power of attorney signed before 2 (two) witnesses, bearing the handwritten signatures of the Personal Data subject, the witnesses, and the authorized representative, along with their respective official identification documents; or (II) a public deed containing the power of attorney granted by the Personal Data subject to the authorized representative or agent.

A clear and precise description of the Personal Data regarding which you wish to exercise any of the ARCO rights, and

Any other element or document that facilitates locating the Personal Data subject's data. Clearly specify the reasons why you believe your Personal Data should be updated, rectified, or cancelled, and/or the reasons why you object to the processing of your Personal Data.

In the case of requests for the rectification of Personal Data, you must indicate the modifications to be made and provide documentation supporting your request.

The Data Controller shall issue a response to the Personal Data subject within a maximum period of 20 (twenty) business days, calculated from the date the request was received, either via email or courier service. The aforementioned timeframes may be extended only in accordance with the Law.

For the purposes of requests for the cancellation of Personal Data, in addition to the provisions of this Privacy Notice, the provisions of Article 26 of the Law shall apply, including the exceptions to Personal Data cancellation specified therein.

--Article 26 of the LEYPP.- The Data Controller shall not be obliged to cancel personal data when:

They relate to the parties to a private, social, or administrative contract and are necessary for its performance and fulfillment;

They must be processed pursuant to a legal provision;

They hinder judicial or administrative proceedings linked to tax obligations, the investigation and prosecution of crimes, or the imposition of administrative sanctions;

They are necessary to protect the legally protected interests of the data subject;

They are necessary to carry out an action in the public interest;

They are necessary to fulfill an obligation legally assumed by the data subject; and

They are subject to processing for prevention, medical diagnosis, or the management of health services, provided that such processing is carried out by a health professional subject to a duty of confidentiality.--

How can you limit the use of your personal data?

To enable you to limit the use and disclosure of your Personal Data, we offer the following option:

Registration on the Data Controller’s exclusion list for advertising or marketing purposes, ensuring that your Personal Data is not processed by us for marketing, advertising, or commercial prospecting purposes.

To exercise this right, you must submit a written request via email to brilamoda@gmail.com and include a complete, legible scan of an official form of identification. Please note that the Data Controller will send any response to the email address from which you submitted your request to limit the use or disclosure of your Personal Data for advertising, marketing, or commercial prospecting purposes (secondary purposes).

How can you revoke consent regarding your personal data?

 

You may revoke the consent you have granted us for the processing of your Personal Data at any time, so that we cease using it.

Your request must include the following information:

 

Official identification (a complete and legible scan).

The specific processing activity for which you wish to revoke consent.

We will have a maximum period of 20 (twenty) business days to address your request, and we will inform you of the outcome via the email account used to submit your revocation request.

 

Regarding requests to revoke consent for the processing of your Personal Data, in addition to the provisions of this Privacy Notice, the provisions of Article 8 of the Law shall apply, as well as the exceptions listed in Article 10 thereof.

How is data collected?

 

The Data Controller collects your Personal Data and information when you visit or register on our website, submit a contact request through it, or send any type of request or information via our email addresses or website. Data is also collected when you make an online purchase and/or acquire a service or product offered by the Data Controller or the Brands, or simply when you provide information or Personal Data to any of our agents or advisors, or via email at: brilamoda@gmail.com.

It should be noted that "THE DATA CONTROLLER" acts on behalf of "THE BRANDS"; therefore, the provisions of this Privacy Notice apply to any user, regardless of the specific website or brand through which they are accessing the services.

BRILA MODA collects user information through various partner websites based on the user's specific profile. These profiles include, but are not limited to, the following:

  1. Sponsors

  2. Speakers

  3. Volunteers

  4. Suppliers

  5. Service Providers

  6. Freelancers

  7. General Participants

The specific distinctions and data to be collected will be determined by the website and, where applicable, the specific form accessed; however, the processing and protection applied will remain the same regardless of the user's profile.

Data Transfer

The “Controller” may transfer your Personal Data to “The Brands,” as well as to individuals and/or legal entities that directly or indirectly participate in fulfilling the services offered by BRILA MODA and its partners.

The Controller will only transmit your Personal Data for the purpose of fulfilling contractual obligations, or obligations arising from or related to the services requested from the Controller; such transfers may be carried out in accordance with the provisions of Article 37, sections IV and VII, of the Law.

Marketing

By accepting the privacy notice, you authorize "THE CONTROLLER"—acting either directly or through "The Brands"—to send you advertising regarding the services or products offered, as well as promotions or updates related to them.

Furthermore, where necessary, you authorize the use of your image and name for advertising purposes, with the assurance that no data other than that specified in this section will be shared.

Such advertising will be sent via the email address provided by you when requesting any of the services. While this is not strictly necessary for the provision of the service, it enhances your experience when engaging with BRILA MODA.

Procedure for notifying changes to the Privacy Notice

The data controller reserves the right to change, modify, and/or supplement this Privacy Notice at any time. We therefore recommend that you regularly check our website, brilamoda.co, or any of our affiliated pages, as any modifications to this Privacy Notice will be communicated to you through these channels.
